That's a good sign for folks who wants to file green card next year and could not file this year becos of bad labor market
The most recent update from the USCIS is showing again a steady approval rate. The jump we saw in October was just due to a more current update of the approval, nit an increase in filing according to the USCIS. If this pace will continue we will see visas all through early 2010, but I may be wrong here...
Ao here is is the update from USCIS: As of November 6, 2009, approximately 54,700 H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap-subject petitions had been filed. USCIS has approved sufficient H1-B petitions for aliens with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H1-B petitions filed on behalf of an alien with an advanced degree will now count toward the general H1-B cap of 65,000. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

While my camera performed better than I expected from a late-90's era 2.7MP DSLR, I didn't fare so well, coming home with far fewer "keepers" than I would have liked. My greatest problem was that I either didn't set up a tripod or failed to increase the ISO to get more DOF in many landscape shots that needed it, and frequently I also got motion blur from lack of tripod usage. This experience has taught me that for me personally, even though the D1 is 2 stops faster than Velvia, I still must slow down and use a tripod - not only to prevent blur and enable slower exposures, but also to force a slower and more thoughtful pace of composition.

Once a person had applied for 485, till they get advance parole if they had gone out of US, the application will be dropped.
I did hear that if you are in H1 B then it is not the case, but lots of Lawyers are advising not to get out of country till the person gets advance parole.
I do remember seeing lots of discussion in one of the portals on this topic, I remember that counselor processing is the option in this type of case.
This is a complex situation, you should consult a lawyer.

I-485 pending for 3 years.
EB2/India � July 2007 filer
I got laid off last year and have been unemployed for 1 year.
I am thinking of applying for California state unemployment benefits. Here are my questions
1) Is there a risk that the EDD office could forward this information to USCIS
2) If the USCIS comes to know about this then is there a risk that they may issue a RFE for an updated job offer and subsequently deny I-485.

I know for a fact that you cannot count current employer exp for GC.
You can use experience with the same employer, but not in the same position as you note next.
If i start working for the same employer on 15-1031.00 Computer Software Engineers, Applications , is it more than 50% different in role so i can count my 3 years experience when applying my GC ??
Nobody could tell just by looking at the DOT job descriptions. Your actual job and duties are what is important, not any DOL codes or descriptions. if your duties in the 2 jobs are 50% different, you should be able to use the experience.

No one can stop it.
Do you all think it is just a co incidense that all the dates became current just when this bill (which was supposed to be in grave :rolleyes: ) is revived by those who extremely opposed it?
Do you know how many people will stop giving a damn, because they just filed their 485 s?
People like me who are result of bad practice employers are still here, and lucky ones will depart.....
We have been dealt a crucial blow here.
No one can stop it.

I'm a july filer and planning on using AC21 to change employers,in this process I'm transfering H1-B,My passport will expire in a month however my
I-94 is valid till 2010. My question is do I need to have a new passport in hand before I transfer my H1??
PS: I've already applied for my new passport and expecting it any time.

Any ways you need to renew, so it is better that you have done it. Apply for H1 renewal after you receive the new passport. you might have to send the copies of your passport and if it was valid for less a moth, you might get rfe, so wait until you get new passport.

but i read somewhere that its better to send chest X-Ray Report with I-693 so that USCIS will not get any excuse to send RFE in the future.
