My lawyer explicity told "NOT" to flipflop even without me asking.

I had a friend in the same situation. Had H1 and EAD. He worked halftime for two years to finish his MBA. Now went back to fulltime H1. I think your company has to approve it and yes he filed ammendment.
Thanks for the info. I am in the process of asking for approval from my company and I don't anticipate major problems.
So far other than H1b amendment I don't see any other actions I need to take. If anybody can think of anything else please reply to this post.

Haitians might be eligible for TPS (Temporary protected status) because of the recent earth quake. Not sure if this applies for people already in USA or not.
Try exploring that. Like Madan said, you would need to be a citizen if you want to sponsor her GC.
Hi, My mother lives in Haiti, i was not able to file a petition for her before the earthquake happened. Now with all of that going on, i need to know how to file and get her quicker to the us? Any response will be greatly appreciated, thank you

IV needs every bit of support that we can provide. The time is past where we sit by and do nothing! It is time for each and everyone of us to let lawmakers of this country know how we are being exploited... or how each and everyone of us has to keep his\her lives on hold for the dream of a GC!
Please do not think sit back thinking "Let them do the rallying... I will enjoy the benefit(s)".
Realize that the rally cannot be a success unless you act and remember that if you do not act, we have little chance of getting the benefit(s). So, shed your fears and insecurities... stand up proud and join us as we try to make this rally a tremendous success!

Hi All,
My employer after too much of talks is ready to file. But in all the applications he wants to put his address so that he receives the EAD card and AP..He is not ready to put my address. Can he keep my EAD card ?

Hi,
I have my Employment based 485 Pending since Aug'2007 (EB-2, priority June'2006, India) and I am currently using EAD for my employment. I am married to a US citizen and have 130 approved on Dec'2008. I want to know what would be my next step.
Can I interfile the pending 485 with the approved 130? or Do I need to file a new 485 and withdraw the pending employment based 485 once I got the new EAD. or Do I need to go for counselor processing?
Please share your experience on this. Any advice will be greatly appreciated.

My received date is Aug 15, 2007.
I looked at the new I485 instructions and the fee now is $985.00.
So i think I payed under the old structure. I am going to include the fee for both of them.

I saw in some forums that the O�Net Code was revised down grading the Specific Vocational Preparation level of most IT jobs to greater than 2 years and up to and including 4 years.
In this way, I read that the key to apply under EB2 is only being �Research� : research into fundamental computer and information science.
Can I be a Software Engineer/Researcher?

When I was researching for the Labor certification and there were few posts which talks about my prior experience and my prior experience would only be considered for the new job if the Job responsibilities are same and the job title is same.
I contacted one of the immigration lawyer and I was told that I can expect RFC's about my prior titles and the current job.

I do not know about I485...
but it is not hard to get copies of W2. IRS has a service that will give you copies of your fed tax papers including W2s in 60 days. You can also ask you employer, they ususlay keep a copy.

I want to start a thread for tracking cases which were transfered from one place to other and to estimate that if we are getting in the back of the queue OR receipt date is acknowledged.
My I 485 transfered from TX to CAL and now to NEBRASKA.
131 AND 765 says received and pending at California
package was received at Texas on 23rd July and Cal center issued notice on Sep 24.
Please let me know if anyone has similar case.

Hi
My H1B expires on sept 30th 2010.(passport has vaild visa also stamped in it till sept 30th)
Extension has been applied . If extension is approved say by august, can I go for stamping in august end.Basically how soon can i go for h1b stamping before old stamping expires.
If there is a problem in stamping can i return on the old visa stamp.

I am planning to apply for EAD and AP. Debating myself if I have to go with e-filing or paper based. Some one told me, paper based DOES NOTrequired biometrics where as E-filing DOES need biometrics? Could you please shed some light on this?

I had applied for my wife through paper and they did not ask for her fingerprints. I had applied for mine through efiling and they did ask for fingerprints. I was not in town on the day that they had asked me to be at the service center. So I requested a later date. Lo and behold one fine day I got my EAD approved without any fingerprints. Don't ask my how it was approved but that is the case.
