Immigration Voice Team and Members,
I guess you may have seen this new bill introduced by Rep. Lofgren. This bill would be a boon to eagerly awaiting qualified candidates. Is there anything we all can do to push this reform!!!
Rep. Lofgren Introduces Bill to Retain International Talent
Bill Would Allow Best and Brightest in STEM Fields to Stay in the United States.
May 14, 2008
Washington, D.C. Rep. Zoe Lofgren (D-CA) recently introduced H.R.6039, which would allow masters and Ph.D. level graduates from U.S. universities in science, technology, engineering, and math to obtain green cards without waiting in long lines, if they have job offers from U.S. employers. The measure enjoys strong bipartisan support, initial co-sponsors include: Reps. Chris Cannon (R-UT), Michael Capuano (D-MA), Chris Carter (R-TX), John Conyers (D-MI), Joseph Crowley (D-NY), Tom Davis (R-VA), Anna Eshoo (D-CA), Wayne Gilchrist (R-MD), Mike Honda (D-CA), Patrick Kennedy (D-RI), Carolyn Maloney (D-NY), Jim McDermott (D-WA), George Miller (D-CA), David Reichert (R-WA), Linda Sanchez (D-CA), Loretta Sanchez (D-CA), John Shadegg (R-AZ), Adam Smith (D-WA), and Ellen Tauscher (D-CA).
More than 50% of the graduates from U.S. universities in masters and Ph.D. programs in science and engineering are foreign born, noted Rep. Zoe Lofgren. If we want our economy to continue competing in the global market, we have to retain these foreign students so they compete with us instead of against us in other countries. These men and women are the innovators of tomorrow, and we arent the only ones looking to retain their talents. Increasingly, employers from Europe, Australia, Canada, and even China and India, are beating U.S. employers for valuable talent. In 2000, for example, 75% of the worlds engineers were hired by U.S. employersjust six years later in 2006, that percentage dropped to 63%. This legislation will give U.S. employers another tool to recruit the worlds best and brightest.

I had contacted all the senators and house reps in New Mexico via their website and heard back from Senator Jeff Bingaman.
Please see his reply:
Thank you for your letter regarding relief measures to raise the quota of employment-based legal immigration visas. I appreciate your taking the time to write. I understand the important contributions made by high-skilled immigrant workers in our economy, and I will certainly keep your concerns in mind as we debate immigration reform in the 110 th Congress.
Again, thank you for writing. Please continue to keep me informed regarding this or any other issue of importance to you.
Sincerely,
JEFF BINGAMAN
United States Senator

We filed our 485 on July 2nd 2007 at Nebraska office EB3 July 7, 2001
- The case was shifted to Texas and we received notices from Texas office with receipt date of August 27.
- Our date is now current however processing at Texas is still stuck at June 27, 2007.
- Does this mean our RD is now 08/27/07 even though it was recd. at Nebraska on 07/02/07??
Check your I-797 - receipt notice for your I-485. In that there is a received date. That is your RD. There is another field, notice date or ND that might change depending on the transfer. If the RD is different from July 2nd, you can talk to the customer service and try to get it corrected.
BTW, though they have to process in the order of RD, I don't think they are following it. From reading here and other forums, I think they are following the ND.

Looks like CIR has a rough road ahead:
From immigration-law:
06/14/2006: AILA Reports Anti-Immigrant Calls to Congress Outnumbers Pro-CIR at 400:1
* AILA has reported that immigration restrictionists are flooding Congressional phone lines and email inboxes with angry demands that their Senators and Representatives vote against any legislation that provides a path to citizenship for undocumented immigrants. Their calls for an enforcement-only immigration policy are reportedly louder and more aggressive than ever and there are 400 of them for every 1 call from proimmigrants. AILA is concerned that the 400 to 1 intensity of the opposition to comprehensive immigration reform (S. 2611) is expected to crescendo into the November elections, making it a likely voting issue at the polls.
* Considering the fact that most seats in the House are up for grab in the November election, these anti-immigration forces pose a powerful threat and road block to meaningful enactment of comprehensive immigration reform legislation.
* These anti-immigration forces also appear to use a strategy to weaken the pro-immigration forces by inducing the immigrant community more and more divided between the legal and illegal immigrant communities and pushing them further and further antagonistic each other by spreading rumors that illegal immigrants would take away employment-based immigrant quota from the legal immigrants and the legal immigrant community should oppose the comprehensive immigration reform legislation as passed by the Senate. "Divide and Conquer" strategy appears to work for these immigration restrictionists.

They will go to ur michigan address i guess.
Online u can change the address for each receipt number of ead ,485 and ap using ar-11 form online link. or u can also call custom rep also to make sure it is reflected.FP notice they will send a copy to ur lawyer .So ask him to let you know once he gets it. sending ar-11 form itself does not change the address against the recipt numbers.

Sorry to hear about your upcoming hardship..
I 've had a similar situation recently - where my H1B (with employer A) was about to expire and then another employer (B) had to recruit me, they filed for transfer+extension.
In I129 while filing, they would have to select (cant recall the exact verbiage) new employer (related to transfer) AND extension of current status. Its better to file this kind of petition premium. I got the new approved petition within 2 weeks with new expiry date as +2yrs, with start date earlier than the H1B expiry date (with A).

You can renew within 120 days before the EAD expire.
I just renewed mine and my wife. My daughter is 16 and she's AOS, but don't have EAD. I am planning to apply for her EAD next month.

Even if your status changed to H1 in October 2004 and you started working in November 2004 for a second employer following approval for that employer, I would say it is just 30days and would not be an issue in future GC application. Don't worry about it.
What do you mean by that. Is she going to file green card in future? She did not say that. May be she wants to go back to her native country once H1 expires.Am I right? H1 visa are given to stay here temporarily for 6 years not to get green cards.First husbands get green cardsm then spouses get green cards, then their parents and in-laws get green cards. This is why lot of primary H1 people are stuck in the line for past 8-9 years without promotions, salary hikes, buying homes. When there are no job for primary H1s, don't understand why spouses want to work. That's why lot of folks are going back to their native places.Competition wihtin out guys. Its like siblings fighting for same job in a single family.

Hello,
I wonder if there is anybody who could help me with my questions about the diversity visa in US.
I was among the randomly selected people for DV 2009. Currently I am in US with F-1 visa. I learned that I am eligible for Adjustment of Status. Do you think it is reasonable to process my files in US or should I go back to my country?
What kind of documents should I fill in? Also I need to pay the filing fees (for I-485 $930 for example). Are there any other costs? I also read that there is a medical examination report, how much could it cost to me?
So after reviewing everything what will be the best decision for me? I asked an attorney but he didn't have enough of experience to help me, and I can not afford one more attorney.
I will be thankful if somebody could enlighten me on these.
Thank you very much.

Hello all,
I am currently on H1B visa working for an IT company. I have got an admit for this Fall to do my MS and I was planning to study using my EAD. Now there seems to be some risk in using my EAD and so I want to apply for F1. I have applied for I-485 (Adjustment of status) along with my husband's green card application.
My question is:
1: Is it a problem to apply for F1 if my I-485 is pending approval ? The reason I ask is, F1 is a Non Immigrant visa and I-485 is for a green card (which is Immigrant visa).
2: Would my F1 application cause my 485 to be denied or vice versa ?
Thanks in advance

Some had mentioned in immigration forums that you might be grilled with questions during naturalization process if you had changed employer as soon as you got your GC.If you are not planning for naturalization I assume you are fine.
A 6 month stay with current employer after GC is advised for a smooth naturalization process in future. But this is dark area as there are no posts from GC turned citizens about their experiences.
Thats not exactly true in the context of this thread. You have to work for your GC sponsorer for some period of time before changing employer. Pooch was mentioning his/her GC sponsorer is future employer. So after the GC is approved, he/she has to work for that GC sponsorer not the current employer.

Since my F1 visa stamping is expiring, what is my possibility of visiting India after May 09? Is there any possibility of extending my F1 Visa for another couple of yrs without leaving the country and continue on my OPT? Or any other suggestions? Please help me..
