It is absolutely feasible to do this on your own. After all you are well educated by definition of your H1B visa. The only thing you need from your employer is the letter of employment and you will need a public notary to notarize the affidavit of support.
The rest you can put together yourself. Just filed for my husband and myself at the beginning of May, fingerprints done on June 4th. Going well so far.
We would still need the I-140 application copy (if pending) or approval notice, right? Pl let me know.

- But can a person be unemployed before the 180 days elapse? What happens if person is unable to find a job before 180 days?

Democrats return back to a lame-duck Congressional session in which they have a majority in both chambers. This is the moment to make the effort to pass the DREAM Act and open up the path for hundreds of thousands of young people to enter the university or serve in the Armed Forces.
Major legislation on the agenda between now and the end of the year includes making permanent the Bush-era tax cuts, passing the fiscal year 2011 spending bill or at least passing a stopgap measure to continue to fund the government, extending unemployment benefits, and addressing cuts in Medicare payments to doctors.
There are many important issues on the floor and the position that will be taken by the Republicans is still unclear given they will have control of the House of Representatives in two months.
Despite this, we believe the DREAM Act must be added to the mix. In these past two years of Democratic control, the concerted push for comprehensive immigration reform never materialized. At a minimum, during these last weeks of legislative control, they should seek passage of legislation that would allow undocumented high school graduates � who have grown up in the U.S. � to continue their studies or to join the military.
Similar efforts a few months back failed because critics unjustly denounced the bill as an "amnesty," as if these young people were responsible for having been brought to the U.S. by their parents. Other critics charged that the bill would prove to be a magnet for immigrant parents to bring young children here. Such criticism ignores the real reasons for immigration.
This legislative session is filled with dozens of legislators who have either lost their reelection or are planning to retire. They have nothing to lose by doing the right thing and voting for a bill that will help the economy in the short and long term by preparing our country�s future labor force. And, at the same time, they will be strengthening the military.
Political savvy and determination will be needed to pass this legislation. Opportunities exist to attach it to other bills if it appears that it cannot be approved on its own. With so much at stake , the time to act is now!

I am not an attorney but questions related to your employer etc should not be asked if you enter on AP. They are more focused on those questions when one enters using a work visa of some sorts. I suggest you enter asap using your AP given that it expires in a month get your green card in hand and then you are free man. You can even go back work out of the country for a limited time until you find a project here. By the way congratulations.

They ask you to write A# or Alien# but not the Receipt Number.
Check out the A# in 485/EAD/AP/140 - they should be ideally in synch. If not put the A# from the 485 application because that overrides everything and is still pending....

My I140 (and I485) were filed in May 2010 (EB2, NSC). My attorney just notified me they received an RFE regarding my eduction. Apparently USCIS needs more details on my MSc degree from Poland (integrated, 5 years) and explanation why is it equivalent US masters degree.
Has anyone had a similar hurdle when filing under EB2 with a degree like that? Should I be terribly worried about getting my I140 approved or do cases like that normally go through (provided that an RFE is correctly replied to)?

My mother scheduled a trip to USA on May 1st. I am concerned about her passport. Her old passport got wet on the borders of the first two and last two pages. VISA was stamped in the old passport which seems to be safe. I do not see any wet appearance on the borders of the VISA page. The old wet passport expired anyway. And she got new one. Will it be safe to travel with these two passport having wet old passport containing VISA stamp? Thanks.

sorry to hear about your job loss. AP are supposed to be used during emergencies and it seems you are only planning for a week visit, seems perfect for AP use.
I have used AP many times, never had any problem, most recent visit being in Jan 2009.
H1B is having lot of problems in getting stamped and at POE, but I haven't heard anything like that for AP travelers. Just remember that if I485 is denied for whatever reason, AP also gets invalidated(Meaning out-of-country AP holders won't be able to return!!!!).
I would say go ahead travel on AP. How long can one put life on hold for GC. Its ridiculous.
File AC21 at the soonest to avoid getting denial.

I work for an India based company that has operations in US. I have been travelling back and forth between India and US for about 8 years now. I am currently in US. My labor got approved this January (PD 7/2004) and my company has filed I140 soon after that. I still have 2+ years on my H1B. I am having to transfer back to India soon and shall be based in India for more than a year. What are the considerations if one has to return back to his/her country after I140 is filed? What is the impact on whole GC process? You response is appreciated.

As long as ur company proceeds with your GC process, you are still in the process. You can always get a h1b extension as you have a approved 140. Unless your company decided that they don't proceed with your GC, you are still in line for GC

My gc was filled in nov 2002 from newjersey which has gone to the backlog center in philly....no news after my 45 day letter which i got in june ....
1.I was wonderign if i could change my lawyer now ...and if i could change my gc processing from non rir to rir ?
2.What the odds of changing from non rir to rir?
3.And my gc is filled in eb2 catergory..
4.if i need to change lawyer is it possible?as my lawyer the present one is not exp enough and makes many mistakes ...?

Yes, you have stylus input that you can use. Its just like windows form. If stylus is down while move(like mouse move) then you draw on the bitmap or graphic).

The bottom of the "Receipting & Lockbox" update clearly says that it may take upto 14 days to get physical receipt or Checks cashed for the dates they say Current. Which means July 2nd 485 apps are declared Current on Aug 17th , so the receipts can come as late as Aug31st i.e after Labor day weekend Sep 4th.
Hang in there guys & Maintain Hope - Plan for a Day off with your Client on Sep 18th at DC. The core and some folks are really working very hard for this Rally - Lets at least support them by attending.

I entered on a H4 on my New Zealand passport and it is valid 2010. I now have a H1B ie a I-797A and a new I-94 that is also valid till 2010. I'm leaving the country for the first time to go to Australia.
Do I need to get a new visa stamp for my passport? If I need to get a new visa stamp, do I need to go back to New Zealand or can I do it in other countries?
Can I travel with my passport which shows the H4 visa and carry with me my I-797A and new I-94 to re-enter the country?
